      Korean Intellectual Property Office Fee Revisions

      1.    Increase of Examination Fees

      •  The basic fee and the additional fee per claim for requesting examination have been partially increased:

      • The revisions are applied to the applications of which the Korean patent application date (or the international application date for PCT applications) is August 1, 2023 or thereafter.

       

      2.    Reduction of Registration Fees

      • The basic fee and the additional fee per claim for the registration fee and the annual fee have been reduced:

      • The reduced registration fee is applied to the applications of which a registration decision date is August 1, 2023 or thereafter, and the reduced annual fee is applied to the applications of which a payment date (within the normal payment period) of the annual fees is August 1, 2023 or thereafter.
         

      3.    Introduction of Additional Fees for Divisional Applications

      • Revised to apply a progressive system per number of divisional applications

                 - Current: A new application fee is paid for filing each divisional application
                 - Revision: twice of the new application fee is paid for filing a second divisional application → three (3) times of the new application fee is paid for filing a third divisional application (→ four (4) times of the new application fee is paid for filing a 4th divisional application  → 5 times of the new application fee is paid for filing 5th divisional application or more 

      • Regardless of the number of previous divisional applications, the number of divisional applications is counted from August 1, 2023.

       

      4.    Reduction of basic trademark fees, and adjustment of additional charge criteria for designated goods

      • Reduction of basic trademark fee: the trademark fees at the stage of filing an application and a registration have been reduced by US$10.00 respectively
      • Adjustment of additional charge: the criteria for the number of designated goods have been revised from more than 20 in one class to more than 10
      • An application fee for trademark registration (amendment fee), an application fee for supplementary registration of designated goods (amendment fee), a registration fee for establishment, a supplementary registration fee of designated goods, and a fee for an appeal against final rejection are applied to the trademark application or the application for supplementary registration of designated goods filed on or after August 1, 2023.
      • A reexamination fee and a renewal registration fee are applied from the request for reexamination and the request for renewal filed on or after August 1, 2023.

       

      5.    Reduction of transfer fees for a patent right and trademark right

      •  Reduced transfer fees for a patent right and trademark right
      • The revision is applied from requesting transfer of a right on or after August 1, 2023.
